Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Wavelength Studios LLC ("Wavelength," "we," "us," or "our"), a Wyoming, USA limited liability company. They govern your use of our website and the applications we operate, including Sinai AI (together, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using them you represent that you are 18 or older and that you have the legal capacity to enter into these Terms.

2. The Services

Wavelength builds AI-powered creative tools that turn photos and prompts you provide into generated media using directed templates and models. Features, templates, and pricing may change, and we may add, modify, or discontinue parts of the Services at any time.

3. Your account

You are responsible for the information you provide, for activity under your account, and for keeping your login credentials secure. Notify us at [email protected] if you believe your account has been compromised.

5. Acceptable use and content rules

Your use of the Services is governed by our Acceptable Use Policy. In summary, you may only upload photos that you own or have the necessary rights to use, and you agree not to use the Services to create or distribute content that depicts a real person without consent, sexualises minors, is non-consensual intimate imagery, is unlawful or harassing, infringes others' rights, or is designed to deceive. We may review, remove, or refuse content, and suspend or terminate accounts, that we reasonably believe violate these Terms or the law.

6. Your content and licence

You retain ownership of the photos and prompts you upload ("Input") and, as between you and Wavelength, of the media you generate ("Output"). You grant Wavelength a limited, worldwide, non-exclusive licence to host, process, and transmit your Input and Output solely to operate and provide the Services to you, including processing by our compute and inference providers. This licence ends when the relevant content is deleted from the Services, subject to our Privacy Policy.

You are solely responsible for your Input and for how you use your Output. You represent that you have all rights necessary to provide your Input and that your use of the Services will comply with these Terms and applicable law.

7. AI-generated content

Output is generated by artificial intelligence and is synthetic. It may contain inaccuracies or artefacts, may not reflect real people or events, and should not be presented as a genuine recording. You are responsible for clearly representing AI-generated content as such where required and for not using it to mislead or harm.

8. Output retention

Generated media is stored temporarily and is automatically deleted after 48 hours unless you save it to your device. Wavelength is not responsible for Output you fail to save.

9. Intellectual property

The Services — including the apps, website, templates, models, software, branding, and design — are owned by Wavelength and its licensors and are protected by intellectual-property laws. These Terms do not grant you any rights in the Services other than the limited right to use them as permitted here.

10. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Services or their users. Upon termination, your right to use the Services ends; sections that by their nature should survive (including ownership, disclaimers, and limitation of liability) will continue to apply.

11. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that Output will meet your expectations.

12. Limitation of liability

To the maximum extent permitted by law, Wavelength and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the three months before the claim or USD 50.

13. Indemnification

You agree to indemnify and hold harmless Wavelength and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising out of your Input, your Output, your use of the Services, or your violation of these Terms or of any law or third-party right.

14. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the revised Terms.
